1. Introduction

 

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder. These Terms & Conditions govern access to and use of the FoodWebs website and mobile application (collectively, the “Platform”). By using the Platform, you enter into a legally binding agreement with FoodWebs.

2. Nature of Platform

 

FoodWebs operates as an intermediary marketplace platform enabling users to discover, order, and purchase products or services from independent third‑party sellers, vendors, restaurants, or service providers (“Merchants”). FoodWebs does not manufacture, stock, own, or sell products unless explicitly stated.

3. Eligibility

 

Only persons who are legally competent to contract under the Indian Contract Act, 1872 may use the Platform. Users must be 18 years or older. By using the Platform, you represent that you meet this requirement.

4. User Account

 

Users may be required to create an account by providing accurate, complete, and current information. You are solely responsible for maintaining the confidentiality of login credentials and all activities under your account.

5. Orders & Transactions

 

All orders placed through the Platform constitute a direct contract between the user and the Merchant. FoodWebs only facilitates order placement, payment collection, and communication.

6. Pricing & Payments

 

Prices, taxes, availability, and offers are determined solely by Merchants. Payments are processed via RBI‑approved payment gateways in INR. FoodWebs acts only as a payment collection agent.

7. Platform Restrictions

 

Users shall not misuse the Platform, post unlawful content, attempt unauthorized access, engage in fraud, abuse services, or violate any applicable law.

8. Limitation of Liability

 

FoodWebs shall not be liable for product quality, merchant performance, delivery delays, indirect losses, or damages beyond its control.

9. Termination

 

FoodWebs reserves the right to suspend or terminate accounts violating these Terms or applicable laws.

10. Governing Law

 

These Terms shall be governed by the laws of India. Courts at Odisha shall have exclusive jurisdiction.
